Sea Changes or Ripples on the Pond? Marking the Evolution of Environmental Law

The topics will include a review of recent U.S. Supreme Court cases that mark significant developments in environmental law, including the landmark CERCLA decision in Burlington Northern v. United States; a review of the shortcomings of the NYS Brownfield Cleanup Program and a consideration of how New Jersey’s Site Remediation Reform Act might offer some helpful lessons; an update on the effort to define wetlands after Rapanos and a half hour on ethics topics that should be of interest to the environmental law practitioner who now must address these issues under the new Rules of Professional Conduct that became effective on April 1, 2009.

This program has been approved for a total of 3.5 credits consisting of 3 credits in Professional Practice and .5 credits in Ethics. This program is NOT a transitional program and will not qualify for credit for newly admitted attorneys.
