Rights of People with Disabilities (2009)
The Federal Americans with Disabilities Act Amendments Act, effective
January 1, 2009, has generated much attention. However, there also have
been noteworthy developments in the Family and Medical Leave Act, as
well as on the New York State and local levels. Federal, State, and
local laws apply concurrently, with the law recognizing the greatest
rights for people with disabilities almost always taking precedence in
each circumstance. Individuals and entities covered as well as remedies
also vary. Thus, a potential disability discrimination case should be
considered with claims under multiple laws in mind. This program will
help you advise clients about compliance and, when necessary, to bring
or defend an action for disability discrimination in New York State,
focusing primarily in the areas of employment, public and private sector
public accommodations, and housing.
