Same Sex Marriage in New York (2011)
Same-sex marriages are now a reality in New York, but a myriad of
legal issues remain, not only for couples contemplating marriage in New
York and New York residents who have entered into a marriage, civil
union or domestic partnership in another state or country, but
also for couples who have married in another jurisdiction but reside in
New York. There are many open issues as to how or whether certain
aspects of New York law will be applied to same-sex couples living in
New York, and there are questions regarding the effect of New York
same-sex marriages if the spouses seek recognition elsewhere. And
for couples who marry in New York or any other jurisdiction where
same-sex marriage is authorized, federal laws impose additional
roadblocks to full recognition and equal treatment.
This program should prepare attorneys to give their clients proper
advice and counsel on the numerous issues implicated by same sex
marriage, including estate planning, children, dissolution, divorce,
taxes, pre-nuptial agreements, and interstate recognition of New York
same-sex marriages.
