The Sunshine Act:
Preparing for Mandated Disclosure of Industry Payments to Physicians and
Teaching Hospitals

The
Patient Protection and Affordable Care Act adopted in March 2010
requires pharmaceutical, device, biological, and medical supply
companies to publicly disclose payments and renumeration to
physicians and teaching hospitals for a broad array of activities,
including consulting, speaking, research, education, charitable
contributions, and royalty payments. While the obligation is
on manufacturers to disclose, the information has significant
implications for health care providers.
Designed for counsel for physicians, hospitals, and other
providers, this program will provide an overview of the Sunshine Act
which mandates public disclosure of payments by pharmaceutical, device
and medical supply companies to physicians and teaching hospitals. The
speaker, Tracy Miller, will discuss the information that will be
disclosed under the Act, the compliance risks the Act poses, the
relationship of the Act to new regulations on conflicts of interest in
research, and concrete steps providers should take to prepare for
disclosure, including development of policies about the financial
relationship between physicians/health care facilities and
industry.
