Celebrity and New Media: Right of Publicity and Privacy 101

In today’s “new media” and celebrity-obsessed society, we are constantly bombarded with a supply of newsy information about these famous figures.  As celebrities become an ever-greater part of our cultural vernacular and commercial entities aim to monetize on their image through new media channels, misappropriation and right of publicity claims have increased while the legal responses to such claims have wavered.

With the proliferation of monetized content and new media outlets, what rights do celebrities have to control their image/reputation and benefit from the economic worth of their brand? What constitutionally protected rights do the media and commercial entities have to reference such celebrities?

In this CLE, we will discuss these issues and give a primer on the evolving law of misappropriation and the right of publicity. Panelists will chart the legal history, discuss key developments, and share practical insights into this area.
