FHCDA Listserve

Introduction

The FHCDA Listserve is an email-based forum for discussing the FHCDA:  when you send an email to the listserve, all subscribers will receive it, and any subscriber can reply to it.   Accordingly, subscribers can pose questions about the FHCDA here, and other subscribers can provide their answers. 

The Listserve is offered as a free resource, to facilitate problem-solving in the implementation of the FHCDA.   It available to any one   – including health care professionals, health care attorneys, advocacy groups, policymakers and members of the public – interested in discussing the FHCDA. 

As should be apparent, answers offered by subscribers may or may not be correct, or they may be a matter of debate.  Readers must review listserve answers critically, and use judgment before relying upon them.  It should be equally apparent that this listserve is not a substitute for professional legal advice.

Instructions on how to subscribe, post a message and unsubscribe are at the end of this page.  But please read the guidelines below before you subscribe to the FHCDA list

1.   IMPORTANT ANTI-VIRUS INFORMATION.  All subscribers are required to have recent and updated ANTI-VIRUS software resident on their computers.  Messages delivered by listserves are not passed through Anti-Virus software.  The NYSBA is not responsible for any loss of data or productivity as a result of virus activity that may be inadvertently delivered through this medium.

2.  When you are the person posting a question, please try to give it a clear and concise subject name, e.g., “Surrogate Decision-Making Standard”, or “Confidentiality of Ethics Review Committees.” 

3.   Please include identifying and contact information at the bottom of the messages you post so that other subscribers will know who you are and how to reach you directly.  If your mail system does not have an auto-signature feature, at least include your full name, company name (if appropriate) city, state, and e-mail address.

4.   Make sure that questions and information posted to the listserve is directly related to the purpose of the list.  Do not forward jokes, chain letters or other off-topic messages to this, or any other list.

5.   When you reply to a message received from this list, the reply will automatically be sent to everyone else on the list.  For this reason, we recommend not sending courtesy replies, such as “thank you” and “me too” to the entire list.  If you want to reply to only the sender, use the Forward option of your mail system, and copy and paste the individual’s email address into the To: field.

      If your reply is simply a request to receive a copy of what someone has offered to share, or simply to agree with, or thank someone, please do not reply  to the entire group. Instead, send your response directly to the e-mail address of the person who posted the message by clicking on your "Forward to" button, and typing in, or cutting and pasting in, the e-mail address of the individual to whom you are responding.

6.         If your message is an informative response to someone's question, from which everyone can learn, you should respond and send your reply message to everyone.  However, avoid re-sending the entire message to which you are replying. Cut and paste the relevant parts when replying.

7.    In accordance with common listserve courtesy, please refrain from sending unsolicited "commercial" and/or self-promotional postings to the list. 

8.  This list is provided as a service by the New York State Bar Association (NYSBA).  NYSBA accepts no responsibility for the opinions and information posted on this site by others.  NYSBA disclaims all warranties with regard to information posted on this site, whether posted by NYSBA or any third party; this disclaimer includes all implied warranties of merchantability and fitness.  In no event shall NYSBA be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, arising out of or in connection with the use or performance of any information posted on this site.

9.  Do not post any defamatory, abusive, profane, threatening, offensive or illegal materials.  

10.   Do not post any information or other material protected by copyright without the permission of the copyright owner. By posting material, the posting party warrants and represents that it owns the copyright with respect to such material or has received
permission from the copyright owner.  In addition, the posting party grants NYSBA and users of this list the non-exclusive right and license to display, copy, publish, distribute, transmit, print and use such information or other material.

11.  Messages should not be posted if they encourage or facilitate members to arrive at any agreement which either expressly or impliedly leads to price fixing, a boycott of another's business, or other conduct which is intended to illegally restrict free trade.  Messages which encourage or facilitate an agreement about the following subjects are inappropriate: prices, discounts, or terms or conditions of sale; salaries; profits, profit margins or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection or termination of customers or suppliers.

12. NYSBA does not actively monitor the site for inappropriate postings, and does not on its own undertake editorial control of postings. However, in the event that any inappropriate posting is brought to the NYSBA's attention, NYSBA will take all appropriate action, including and not limited to removing a poster from the list.

13.  Be respectful and courteous.  Do not use the listserve to “flame” individuals, or engage in angry tirades.  

14.  NYSBA reserves the right to terminate access to any user who does not abide by these guidelines.
