Recent Developments in E-Discovery This fast-paced program will cover recent developments in Electronic Discovery and features an overview of recent state and federal cases and statutes. Panelists will provide an update on state law statutory changes including Uniform Trial Court Rule 202.12 [22 NYCRR 202.12], Uniform Commercial Division 202.70, requiring counsel to consider and produce relevant electronic documents in litigation and the new Preliminary Conference Form http://www.nycourts.gov/ip/ediscovery/. Panelists will discuss preservation duty, costs of production and emerging technology. Recent cases including Voom HD Holdings LLC v. EchoStar Satellite LLC, 2012 NY Slip Op 00658 (1/31/2012), U.S. Bank N.A. v. GreenPoint Mtge. Funding, Inc., 2012 NY Slip Op 01515 (2/28/2012) and Silva Moore v. Publicis Groupe & MSL Group, USDC SDNY, 11 Civ. 1279 (2/24/2012) will also be reviewed. The Report of the E-Discovery Committee of the Commercial and Federal Litigation Section of the New York State Bar Association, Best Practices in E-Discovery in New York State and Federal Courts, will provide a framework for the program discussion.
