Sponsored by the New York State Bar Association’s Health Law Section and designed for attorneys either entering into health law practice or interested in learning more about this dynamic feild of practice, this program will provide a framework for understanding a wide range of health law issues. 

Experienced practitioners looking to expand their ability to represent clients in the health care industry will also benefit from this seminar’s overview of the multifaceted field of health law.  Recent developments in the health care industry are also discussed.

The seminar covers legal issues involving health care providers, payors and consumers. Topics include fundamentals of reimbursement, conditions of participation and operating regulations, HIPAA and confidentiality of health information, health care decision making, fraud and abuse, and regulatory compliance.


Agenda

I. HEALTHCARE PROVIDERS - STATUTORY AND REGULATORY ISSUES
This session contains a discussion of the various types of healthcare providers operating in New York, including general hospitals, clinics, home health care agencies, hospices, licensed professionals, mental health facilities, programs for the developmentally disabled, alcohol and substance abuse programs, insurers, managed care entities and government healthcare programs. The discussion provides an overview of the myriad State and Federal regulatory agencies that regulate healthcare providers and the statutory and regulatory scheme they operate within.

II. HEALTHCARE PAYORS - STATUTORY AND REGULATORY ISSUES
This session contains a discussion of the private and government payors and reiombursement systems, including  Medicare and Medicaid Programs, private health plans and ERISA-covered health plans.  Panelists provide an overview of the federal and state statutory and regulatory scheme involved in payment for health care services and the conditions and expectation places on providers of services through government health care programs.

III. HEALTHCARE CONSUMERS – STATUTORY AND REGULATORY ISSUES
This session discusses various federal and state statutory and regulatory consumer protections, rights and obligations. The session focuses on consumer rights to make health care decisions, bioethical issues and personal privacy.             

IV. HEALTH CARE COMPLIANCE AND FRAUD AND ABUSE
This session contains a discussion of regulatory compliance initiatives and obligations and a survey of the significant fraud and abuse laws and regulations applicable to the healthcare industry, including the Medicare Anti-Kickback Statute, the Federal and State Physician Self-Referral Statute, the Federal False Claims Act, State Fee-Splitting Rules and the Corporate Practice of Medicine Doctrine.

V. THE PRACTICE OF HEALTH LAW ROUNDTABLE
Roundtable discussion of the practical and professional aspects of practicing health law from several different perspectives. Panel members include attorneys in private practice, in in-house practice and in government practice.
