Product Description

The Sunshine Act:
Preparing for Mandated Disclosure of Industry Payments to Physicians and Teaching Hospitals

CLE Webcast/Webconference

Sponsored by the Health Law Section of the New York State Bar Association

The Patient Protection and Affordable Care Act adopted in March 2010 requires pharmaceutical, device, biological, and medical supply companies to publicly disclose payments and renumeration to physicians and teaching hospitals for a broad array of activities, including consulting, speaking, research, education, charitable contributions, and royalty payments.  While the obligation is on manufacturers to disclose, the information has significant implications for health care providers.

Designed for counsel for physicians, hospitals, and other providers, this program will provide an overview of the Sunshine Act which mandates public disclosure of payments by pharmaceutical, device and medical supply companies to physicians and teaching hospitals. The speaker, Tracy Miller, will discuss the information that will be disclosed under the Act, the compliance risks the Act poses, the relationship of the Act to new regulations on conflicts of interest in research, and concrete steps providers should take to prepare for disclosure, including development of policies about the financial relationship between physicians/health care facilities and industry.

Reasons to Attend

  • Learn about the requirements of the Sunshine Act and the implications of disclosure for: (i) potential violations of federal and state fraud and abuse laws; (ii) federal regulations on conflicts of interest in clinical research; (iii) potential liability for treatment and research for failure to disclose financial interests, and (iv) media attention.
  • Know what information will be publicly available about payments made by pharmaceutical, device, and other manufacturers to physicians and teaching hospitals under the Sunshine Act
  • Learn about the legal risks of public disclosure under the Sunshine Act for physicians, physician groups, hospitals, and other providers with employed or affiliated physicians
  • Learn about what providers can do to prepare for disclosure and mitigate risk
