*** WELCOME! *** 
Welcome to the Committee on Animals and the Law Web site. This
Committee was conceived by Association Past President Lorraine
Power Tharp, who wanted to highlight the growing field of Animals and
the Law and to educate the profession, specifically the membership,
about the issues that arise in the law in relation to animals.
The current officers of the Committee are JAMES F. GESUALDI, Chair; AMY
L. CHAITOFF, Vice-Chair; and CATHERINE R. KEENAN, Secretary.
Issues with animals occur in several arenas of the law: housing, real
estate, health, agriculture and business, to name only a few.
Attorneys have only recently begun practices that
include Animal Law, which makes it one of the more exciting fields
of law for this Web site to feature. These Web pages host a variety of
information for Committee members and visitors who have an interest in
the growing field of animal law and will introduce members and site
visitors to one of the New York State Bar Association’s newest
Committees. Feel free to browse around the Web site and see
what the Committee is doing! Plans are being made to feature a Mentors
in Animal Law listing and other helpful resources for attorneys or the
public to turn to for advice about animals and the law.

New York City violated the Animal Shelters and Sterilization Act
(9/16/09)
In September 2009 State Supreme Court Justice Marilyn
Shafer found that the City violated the Animal Shelters and
Sterilization Act, NYC CODE § 17-801, and ordered New York City to
submit to it a plan to open animal shelters in all five boroughs and
keep those shelters open 24 hours a day, seven days per week to receive
and permit the adoption of dogs and cats. Pursuant to the Act, the
City was required, but failed to ensure that a full-service animal
shelter was maintained in all five boroughs on a 24 hours a day, 7 days
a week basis. The City intends to appeal this decision.
