The Frye and Lafler Decisions: Effective Assistance of Counsel Before Entering the Courtroom—In March 2012, the Supreme Court jointly decided Missouri v. Frye__U.S.__, 132 S. Ct. 1399 (2012) and Lafler v. Cooper __U.S.__, 132 S. Ct. 1376 (2012); holding that plea negotiations were a critical state of the criminal proceedings, requiring effective assistance of counsel. This program will analyze these important issues, consider the federal rule in light of New York’s Constitution, and challenge the attendees to consider different consequences and scenarios where these cases may be utilized in seeking relief for your client.

Reception/Luncheon 12:00 p.m. – 2:00 p.m.

Under New York’s MCLE rule, this program has been approved for a total of 3.0 MCLE credit hours in Areas of Professional Practice. This program will not qualify for newly admitted attorneys because it is not a basic practical skills program.
