Assistance of Counsel Before Entering the Courtroom—In March 2012,
the Supreme Court jointly decided Missouri v. Frye__U.S.__, 132 S. Ct.
1399 (2012) and Lafler v. Cooper __U.S.__, 132 S. Ct. 1376 (2012);
holding that plea negotiations were a critical state of the criminal

will analyze these important issues, consider the federal rule in light
of New York’s Constitution, and challenge the attendees to
consider different consequences and scenarios where these cases may be
utilized in seeking relief for your client.

newly admitted attorneys because it is not a basic practical skills
program.
