Power of Attorney Forms (Downloadable)

The Statutory Durable Power of Attorney and the Statutory Major Gifts Rider goes into effect on September 1, 2009. The Statutory Major Gifts Rider must be completed to grant an agent authority to make major gifts.

Although the specific language of the statutory forms cannot be changed, modifications can be made in subsection (g) of the Power of Attorney form and under paragraphs (b) and (c) of the Statutory Major Gifts Rider Authorization. A review committee, chaired by Michael O’Connor, of Delaney and O’Connor, Syracuse, developed the suggested clauses that follow these forms. These clauses could be included as Modifications to the Power of Attorney form and the Statutory Major Gifts Rider Authorization. You are strongly encouraged to consider inserting the clause regarding the revocation of prior powers of attorney under paragraph (g) to avoid the unintended consequences of revoking powers of attorney made for a specific purpose. Please note that some of these clauses are mutually exclusive and should be inserted in accordance with the direction/best interests of the Principal. You should also enter your own modifications, as appropriate, to best meet the needs of the Principal. For your convenience, these forms are being provided in both Microsoft Word™ and WordPerfect™ formats.

Please Note:
A bill (A.8392-A/S.5910) has been introduced which amends the above-referenced Statutory Power of Attorney form. In the event that this bill becomes law, one notable change would be that the execution of the Power of Attorney form would no longer automatically revoke previously executed power of attorney forms.
