PROGRAM DESCRIPTION
This program is designed for recent law school graduates and newly admitted attorneys to “bridge the gap” between law school and the realities of practicing law in New York State. Learn practical information from skilled and experienced practitioners and get the skills you need to make a smooth transition from law student to attorney. Newly admitted attorneys can satisfy all of their annual MCLE requirements by attending this two-day program.

Important Note: This Bridging the Gap is a repeat of the Spring 2009 program, therefore, attorneys who attended that program are not eligible to receive MCLE credit for this program.

The program is being presented in three (3) locations in an interactive video conference approved for newly admitted attorneys. Those who attend the live New York City session will interact in “real time” with attorneys at the Albany and Buffalo locations and vice versa. All program faculty will speak from the New York City location.

Day 1 will cover topics in various areas of practice and includes segments on Ethical Considerations for Trusts and Estates Lawyers; Persuasive Legal Writing; Practical Guide to Solo Practice; Commencing a Civil Lawsuit in New York State; Landlord and Tenant Rights During and After Foreclosure; and Basics of Handling a Workers’ Comp Case in New York State; and offers 1.5 credit hours in skills, 5.5 in areas of professional practice, and 1.5 in ethics.

Day 2 includes segments on Mediation: What You Need to Know to Make the Process Successful; Drafting Basic Elder Law Planning Documents; Basics of Employment Law; Using and Handling a No-Fault Case in New York State; Ethical Considerations for Business and Transactional Lawyers; and offers 4.5 credit hours in skills, 1.5 in areas of professional practice and, 1.5 in ethics.

Bound course materials containing outlines, sample forms and useful checklists for handling cases in various areas of practice will be distributed to registrants each morning of the program (Volume 1 on Wednesday and Volume 2 on Thursday).

This session will cover the informal process of mediation. The speaker will discuss effective use of mediation in both a law suit and in a less formal negotiation process. He will discuss issues of when to use a mediator, how to select a mediation, confidentiality of the process, reasonable expectations, and how to reach agreements with a mediator.

Business people often like to work informally when they start companies or “do deals”, but that informality can create ethical problems for an attorney, and if you’re not careful you may find yourself serving “multiple masters”. Topics will include: Who (or what) is the client; Avoiding and waiving conflicts of interest; Drafting “aggressive” vs. “win win” transaction documents; The ethics of business negotiations-When you know something the other side doesn’t; Dealing with mixed law and business issues; Owning equity in your client; and other practical concerns that arise when representing a business.
