PROGRAM DESCRIPTION

The Committee on Public Utility Law of the New York State Bar Association’s Business Law Section is proud to present the Eleventh Annual Institute on Public Utility Law, featuring top experts speaking on topics of particular importance and timeliness to practitioners in the energy and telecommunications areas.  An outstanding faculty representing corporate attorneys, government agencies, and leading law firms will cover some of the latest developments in these areas, as described in the agenda.  There will be breakout sessions during the program so that those present may select the topic that interests them most.  Attendees will receive a detailed set of course materials prepared by the faculty.  Utility legal staff, regulators, and all practitioners representing energy and telecom providers are strongly encouraged to attend.

8:30 - 9:00 a.m.  REGISTRATION (outside meeting room)

9:00 - 10:00  OPENING KEYNOTE – CYBER SECURITY AND PRIVACY
The ability to protect utility customer data is an on-going challenge for privacy professionals.  An industry expert
will provide an update on the legal issues and the role of lawyers in keeping this information secure.

10:00 - 11:00  OPENING PLENARY SESSION
Federal Stimulus Grants
This session will examine the process for qualifying and receiving grant monies under the American Recovery
and Reinvestment Act for utility projects, including broadband, smart grid, energy efficiency, and alternative energy.

11:15 - 12:30 p.m. MORNING BREAKOUT SESSIONS  (choose either Telecom or Energy Session)

      TELECOM:  State Broadband Policies
     As  the country focuses more on the availability of broadband, New York State has been working
     on a variety of policies designed to increase availability, digital literacy, and adoption.  This session
     will focus on New York State broadband policies from the perspective of three state agencies:
     CIO/OFT, NYSTAR, and CSCIC.

     ENERGY:  Linear Projects: Environmental Siting Issues Regulatory And Developer Perspectives
    This session will present a panel of speakers from government and industry that will discuss topics
    such as environmental reviews, permits, and approvals for pipelines and transmission lines.  Where
    does the PSC and the DEC authority begin and end?  Which agencies are responsible for
    environmental approvals for these linear projects and how do the agencies interact with each other? 
    What are some of the important considerations behind developing an effective strategy?

      Telecom:   The Future of Local Telephone Service (Roundtable)
     With the emergence of wireless and VoIP, the local telephone service market has changed considerably
     since the rules governing the service were created.  Should legacy local exchange service rules
     be applied to alternative providers or should a new regulatory be created?

      Energy:  Submetering & Tenants Rights
     Submetering electricity has become a popular component of the state’s regulatory and energy policies.

Settlement Negotiations   
At a stressful settlement negotiation session at the Public Service Commission between a utility, large
customers, consumer advocates, and Commission counsel, several unexpected ethics and professional
conduct issues arise.  Prof. Connors will begin the session with a 15 minute overview of recent changes
to the ethics requirements in New York.
