Program Description

This fall, our “Update” program on the most recent developments in areas that New York attorneys regularly handle will cover civil procedure; matrimonial and family law; trusts and estates law; business and corporate law; criminal law; and ethics and professionalism.

All that is new in each field—cases, statutes, rules, procedures and practice techniques—will be reviewed by an experienced faculty member. The program agenda below lists just some of the highlights featured in this year’s program.

Live sessions of Update 2009 will be presented in Syracuse and New York City. Videotaped replays will be shown in seventeen locations around the State. Please note that we are recording both the Syracuse and New York City sessions, and each video replay will feature the recording of the live session most appropriate to that geographic locale—video replay sites in the First and Second Departments will show the New York City recording; video replay sites in the Third and Fourth Departments will show the Syracuse recording.  Please note:  Newly admitted attorneys may only receive credit for attendance at the live sessionsnot the video replays.

Written materials highlighting and digesting all the latest developments in these five subject areas will be distributed at the live and video replay sites.

Topic Descriptions:

BUSINESS AND CORPORATE LAW
The Business and Corporate Law Update will include a discussion concerning: (1) statutory changes and case law development affecting Limited Liability Companies; (2) statutory changes and case law development affecting Business Corporations; (3) statutory changes and case law development affecting Partnerships; and (4) Recent Tax Law Development.

CRIMINAL LAW
The Criminal Law Update will include a discussion of new issues concerning: (1) search and seizure; (2) enhancement of sentences; (3) insufficiency of evidence claims; (4) methods of preserving issues; (5) new restrictions on “deadlock” instructions; and (6) recent evidentiary rulings, along with other important criminal law matters.

ETHICS AND PROFESSIONALISM
New York State was the only state in the United States to follow the outdated ABA Model Code of Professional Conduct (the Code).  Effective April 1, 2009, the Rules changed. In an effort to clarify and simplify the laws governing attorney conduct, the Administrative Board of the Appellate Divisions has approved the Rules of Professional Conduct (the Rules), based on the American Bar Association’s Model Rules of Professional Conduct. This program will provide an overview of what rules have totally changed, what rules have been somewhat modified, and what rules remain the same.

MATRIMONIAL AND FAMILY LAW
This presentation and its accompanying written materials will provide a comprehensive overview of the last year's developments in the key areas of grounds for divorce, equitable distribution, maintenance, child support, counsel fees, new legislation and amendments to court rules, in addition to other topics.

NEW YORK CIVIL PRACTICE
The New York Civil Practice update will include discussion on disputes about the notice of claim; removing cases to federal court; longarm jurisdiction on Internet purchases; new OCA expedited procedure when TRO sought; consequences of mailing papers from outside state; conflicts on using personal jurisdiction of debtor to get at property debtor controls outside state (fixing situs of intangible property interests); "general pattern of delay" showing needed in neglect to prosecute cases; trying to contest clerk's date stamp; clarification of who may make service outside state; making polling of jury absolute right;  dispute on whether "condition" of conditional disclosure order is ever  absolute; new requirement that defendant's insurer attend conferences; need of deposition before P gets surveillance tapes from D; more on hazards of using mere "notice" to start action; counsel's continued exposure for expert fees; steps prescribed for identifying unknown parties; problems on subrogation versus collateral source in tort cases under Court of Appeals Fasso case; need to reveal settlement to nonsettling parties; consequence of not submitting judgment under 60-day rule; issues on D's ex parte interview with P's treating MD; burgeoning arbitration issues including review standard, getting discovery from non party, effect of arbitrator's not hearing witnesses; may "mediation" be compelled?; new rule mandating conference in mortgage foreclosures; penalty for lawyer not paying sanction assessment; new protections for exempt income of small debtors; penalties for lawyer letting others sign name;
NY firm's liability for negligence of foreign lawyer; treble damages against lawyer for fraud in pleading; computing attorneys' fees as frivolity sanction; time limit on voir dire; inconsistencies about notice requirements for cross-relief; both criminal and civil penalties for "sewer service"; and many more ...

TRUSTS AND ESTATES LAW
The Trusts and Estates Law Update will include a discussion concerning (1) Recent Trends and Developments in Estate Planning, (2) Tax Acts and Legislative Proposals (and especially the status of estate tax reform), (3) Recent IRS Regulations and Announcements, (4) Recent Court Decisions, and (5) New York Statutory and Case Law Developments.
