Program Description:

It’s an issue attorneys face on a regular basis: We’re owed money from our clients, but have trouble navigating New York’s complex rules concerning charging and retaining liens. This valuable CLE program will help untangle the rules pertaining to the State’s Fee Dispute Resolution Program and more. Our informative and lively panel will discuss issues including the timing of serving the notice of right to fee arbitration, papers in the fee arbitration and the procedures of the fee arbitration before the proper forum. Other topics covered will include collection actions and best practice for risk management. Please join us!

Join us for a reception prior to the program—Hors d’oeuvres and drinks will be served.

Business or business casual attire.

Panel:

  • Hon. Shlomo S. Hagler, Acting Supreme Court Justice, New York County
  • Richard A. Klass, Esq., Your Court Street Lawyer, Volunteer Attorney Fee Arbitrator
  • Domenick Napoletano, Esq., Napoletano Law Firm, President of Brooklyn Bar Association and Chair of the Part 137 Attorney Fee Arbitration Program

Topics:

  • Liens (Retaining lien, Charging lien, Statutory liens, Liens/Judgments against client’s property)
  • Fee Arbitration (Retainer agreement, Right to fee arbitration, Fee arbitration process, Waiver of rights, Trial de novo)
  • Collection Actions (Pre-action activities, Court action, Breach of contract, Quantum meruit/unjust enrichment)
  • Ethical/Professional Concerns (Billing concerns, Grievance arising out of liens/actions, Legal malpractice concerns, Disclosure of client’s confi dential information, Reporting on insurance applications)
