Join the Trademark Law Committee of the Intellectual Property Law
Section for a roundtable event on recent developments and strategies
concerning treatment of intellectual property and IP licenses in
bankruptcy proceedings and disposal of distressed assets.
Our panelists will be discussing issues of particular concern,
including:
- Bankruptcy treatment of “executory contracts” and
criteria for determining whether a licensing agreement is an
“executory contract”
- Special provisions of the Bankruptcy Code governing intellectual
property
- Differences between the bankruptcy treatment of trademarks and other
types of IP
- Strategies for dealing with a licensor’s or licensee’s
bankruptcy filing
- Due diligence of licensing agreements to identify potential
bankruptcy issues
- Emerging and unresolved issues in the bankruptcy treatment of
IP

Panelists:
James W. Grudus, Chief Creditors Rights Counsel, AT&T
Mr. Grudus specializes in complex insolvency issues,
including corporate development and strategic evaluation initiatives,
bankruptcies, and regulatory matters. He attended both Seton Hall
and Yale Law Schools, where he was an editor of the Yale Journal on
Regulation and co-founded the Yale Law and Technology Society. Mr.
Grudus did his undergraduate work at the University of Rochester where
he earned a Bachelor of Science degree in applied physics and a Bachelor
of Arts degree in History.
Casey Servais, Associate, Financial Restructuring Dept.,
Cadwalader, Wickersham & Taft LLP.
Mr. Servais
concentrates his practice in the areas of bankruptcy law, international
insolvency law, and financial restructuring. He graduated with
honors from the University of Chicago and received his J.D. from Yeshiva
University’s Benjamin N. Cardozo School of Law, where he was the
Floersheimer Fellow for Law and Humanities, a member of the Cardozo Law
Review, and the Senior Editor of the journal Law & Literature.
Before attending law school, Mr. Servais earned a Ph.D. from Cornell
University and was a Fulbright scholar at Humboldt University in
Berlin. In addition to his practice, Mr. Servais has authored or
contributed to articles that have appeared in Law 360, the Restructuring
Review, and the American Bankruptcy Institute volume
