CAPS BLOGGING PRINCIPLES

 

1.    My work for The CAPS Blog, a NYSBA “entity” blog, is voluntary and performed as a NYSBA member with the primary purpose of advancing the knowledge and understanding of public service attorneys about matters that may impact their day-to-day practice.  I am not an employee or independent contractor of the NYSBA.

2.    I will not directly or expressly use my position as author for The CAPS Blog to solicit legal business or to conduct advertising for myself or any other lawyer or law firm.  While the interpretation of this principle is initially my responsibility, the ultimate determination of my compliance is the province of the administrator and the Committee of Attorneys in Public Service (“CAPS” or “Committee”) Chair.  It is understood, however, and in fact hoped for, that my contribution to The CAPS Blog will by its very nature widen the audience of people who know me, and that the content of my posts may be read with interest and respect, garnering the esteem and good will of my peers and others in the legal profession.

3.    I will select topics based primarily on the value of the subject matter to attorneys working in public service, in light of my knowledge and experience as a public sector attorney in the state of New York.

4.    In developing and publishing posts on The CAPS Blog, I will use reasonable efforts to refrain from plagiarism and other acts that materially infringe on the intellectual property rights of others.

5.    I will strive to produce posts that are cohesive with the overall style, structure, and tone of The CAPS Blog.  All posts are subject to editing or deletion by the administrator, in the administrator's discretion.  I may work with either the administrator and/or the Committee leadership to modify the material accordingly and I retain the right to demand that NYSBA remove any posts that have been modified in ways with which I do not agree.

6.    I recognize no proprietary interest in the posts I produce for and post to The CAPS Blog.  My submission of the posts is a voluntary grant of license to the NYSBA and the Committee to display the posts on the blog and/or reproduce the posts, upon attribution, in other NYSBA forums.

7.    I will immediately report to the administrator any abusive or inappropriate comments to my posts of which I am aware.  I will not respond to such comments or engage such commentors in any way.  Response to such comments is in the discretion of the administrator.

8.  I have read and agree with this NYSBA Blogging Policy and will use reasonable efforts to abide by it now and as it may be modified from time to time.

9. My position as a blog author is a privilege extended by the NSYBA and the leadership of the Committee and may be revoked at any time, for any reason, by the administrator or the Committee leadership.

10. I will comply with the Ethics rules as outlined in McKinney's Public Officers Law § 74 as well the Rules of Professional Conduct.
