Damage awards in Right of Publicity cases have been skyrocketing.  Multimillion dollar awards and settlements have become more commonplace and celebrity and other plaintiffs routinely have been pressing for large awards for claimed unauthorized uses of their names, likenesses and sometimes even their personas.  But judges are starting to push back. 

The explosion of advertising and marketing on the Internet and other non-traditional advertising has led to a blurring of the traditional lines between pure advertising and commercial content, greatly increasing the exposure to Right of Publicity claims.

This panel will explore the issue of damages and other remedies in Right of Publicity cases. The program will include a discussion of the history and development of Right of Publicity Law, and an exploration by experts in the field as to the ways that claimants are seeking, and defendants are attempting to avoid, large awards.  We will talk about recent cases and claims involving Woody Allen, Paris Hilton, Michael Jordan and many others and discuss the ways that courts in different jurisdictions are dealing with various damage theories.
