STATEMENT BY THE NEW YORK STATE BAR
ASSOCIATION ON RECENT CRITICISM OF COURT DECISIONS
Public respect for the courts is essential to the maintenance of a
democratic society governed by the rule of law. While the First
Amendment of the Constitution entitles Americans to criticize judicial
decisions and the judges who make them, any such public criticism should
be tempered to reflect the disagreement in a way that does not inflame
the public. The State Bar Association urges that those who criticize
court decisions do it in a manner that respects the important and
difficult role the judiciary plays in protecting all of our rights.
