Experience Over 35
years experience as a litigator, negotiator, arbitrator, and mediator.
Representation of Fortune 100 and Fortune 500 corporate policyholders to
recover insurance coverage for clean up of superfund sites, officers and
directors insurance for securities class actions, fiduciary bond
insurance for theft of corporate assets, etc., involving primary, excess
and umbrella insurance over two billion dollars. The underlying cases
involved chemical, communication, electronics, computers, and steel
manufacture and required knowledge of those industries. Served as
national counsel for asbestos defendants in charge of directing and
coordinating more than 35 local counsel in over 100,000 cases. Total
amounts of damages claimed in the asbestos cases exceeded several
billion dollars. Defense of complex securities claims, including class
actions.
Alternative Dispute Resolution
Experience Experienced sole arbitrator,
panel chair, or panel member in over 80 matters involving commercial
business, securities, breach of contract, employment, insurance,
brokerage disputes, franchise related claims, and torts. Arbitration of
large securities related claims and customer broker claims, employment
(wrongful termination), franchise agreements and general commercial
claims. As a mediator
of more than 150 matters, including a class action involving
governmental entities and objecting intervenors, software supply contract with a large investment
banker, distributorship disputes, employment disputes (race, gender and
ADA discrimination and sexual harassment), franchise agreements,
securities (broker dealer, customer and employment matters) and breach
of contract claims. Trainer of
arbitrators and mediators.
