David C. Singer

Co-Chair
David Singer’s focus is in the area of litigation, arbitration
and other dispute resolution -- with 30 years of experience as an
advocate and 20 overlapping years of experience as a neutral arbitrator
and mediator -- focusing on business contracts, business torts,
executive employment agreements, employment discrimination and other
business and employment matters.
Mr. Singer has successfully tried and defended cases in federal and
state courts and arbitrations, and represented clients in appellate
arguments, mediations and negotiations. He provides extensive
business and employment counseling to clients, including on litigation
avoidance, risk assessments and preparedness. Cases have included
arbitration between high-tech Chinese and Brazilian corporations
involving claims of breach of contract for failure to provide conforming
product and counterclaims for theft of computer software and related
technology (award in favor of respondent on defense and counterclaims);
trial of contract and unfair trade practices claims between solarium
manufacturer and distributor in federal court (jury verdict for
defendant and award of counterclaims); defense of
discrimination/whistleblower action in Michigan federal court involving
retaliation and unlawful termination of employment (summary judgment
awarded in favor of defendant); defense of claims of breach of
restrictive covenant, confidentiality agreements, fiduciary duty and
tortious interference (summary judgment awarded in favor of defendant;
affirmed on appeal); defense of age discrimination case (successful
trial before N.Y.S. Division of Human Rights); AAA arbitration for owner
in construction dispute (after 22 days of hearings, settled for nominal
amount); trial between Argentinian jet aircraft distributor brought by
prior owner alleging interference with contract (three week bench trial
in New Jersey Superior Court, decision in favor of defendant); New
Jersey litigation involving claims by independent contractor for unpaid
sales commissions and other compensation (favorably settled); AAA
arbitration concerning real estate partnership dispute among partners,
including contract, fiduciary duty, constructive trust and fraud claims
(after arbitration, award in favor of respondents); ICC arbitration on
behalf of British pension fund regarding alleged multi-million dollar
breach of stock purchase agreement involving sale of hotel and office
complex (favorably settled); action involving commodities investment
consulting agreement, including contract, fiduciary duty, securities and
commodities claims (partial summary judgment granted and affirmed on
appeal; successful bench trial of remaining claims); federal claims
involving international indirect securities holding systems (dismissal
of claims, affirmed on appeal by Second Circuit); commercial lease
dispute (after bench trial, decision in favor of defendant); partnership
dissolution action (after trial involving valuation of commercial and
residential real property, decision in favor of defendants).
As an arbitrator, Mr. Singer has arbitrated more than 100 cases,
including breach of dealer contract between large telecommunications
company and dealer; breach of employment agreements between former
executive employees and financial institutions; breach of series of
contracts between insurance company and pharmaceutical company; breach
of agreement concerning sale of accounting firm; breach of agreement
between importer and distributor of alcoholic beverages; breach of
contract involving sale of restaurant business; contract dispute between
major electronics manufacturer and computer software vendor;
determination of liability for losses between purchaser and seller of
seed company.
As a mediator, Mr. Singer has mediated more than 100 cases, including
disputes between supplier and purchaser of computer technology products;
financial institutions and former executive employees; law firms and
former partners; religious institution and catering and restaurant
vendor; retail employer, EEOC, ethnic based rights organization and
former employees; sellers and purchasers of businesses; real estate
owner/developer and consultant/broker; and employment discrimination
cases.
Mr. Singer received his law degree from New York University School of
Law and undergraduate degree from the University of Pennsylvania.
He is admitted to practice in New York and New Jersey.
