DEALING WITH RESIDENTIAL FORECLOSURES:
New York State Bar Association Offers New CLE
Course in Albany, Buffalo, Tarrytown, Syracuse, Manhattan, Melville
& Rochester
In response to the alarming increase in foreclosures throughout New
York, State Bar Association President Michael E. Getnick of Utica
(Getnick Livingston Atkinson & Priore, LLP and of counsel to Getnick
and Getnick of New York City) announced today that the Association will
offer a new CLE course, Dealing With Residential Foreclosures: Defenses,
Remedies and Other Approaches to Resolution at seven locations around
the state starting in Albany on Monday, June 15th.
Co-sponsored by the Real Property Law Section and the Committee on
Continuing Legal Education of the New York State Bar Association, the
course is designed to help attorneys understand new foreclosure
procedures, as well as the foreclosure defenses and remedies from the
borrowers' standpoint.
An expert faculty will provide an overview of current legislation
along with recent court cases. Among the other course topics will
be new developments that may affect the borrowers' ability to negotiate
short sales, deeds in lieu of foreclosure, forbearance agreements, and
other settlement tactics.
Getnick said, “As the recession continues to exact a toll on
New Yorkers at all economic levels, one of my priorities as president is
to ensure that the State Bar provides lawyers with practical and useful
tools that will keep them apace of new legislative, policy and
procedural developments and allow them to better serve and protect their
clients.”
Joel H. Sachs (Keane & Beane, PC), chair of the Real Property
Section added, “In the wake of the national housing meltdown,
federal and state governments, as well as private lenders, have either
proposed or enacted a host of additional rules on borrowing, lending and
foreclosure. Attorneys who attend this program will have the
critical up-to-date understanding of this new legal landscape -- both
nationally and locally -- that will enable them to provide the best
counsel in these difficult times.”
Participants will receive 7.5 credit hours of practice management
and/or professional practice. The course may be used for New York
MCLE credit by all attorneys, including those who are newly admitted
(less than 24 months).
Among the course topics are:
• Understanding the Residential Foreclosure Process
• Understanding Consumer Protection Laws
• Understanding Mortgage Loan Products
• Whom Do You Deal With in a Loan Workout?
• Options for the Mortgagor's Attorney
• The New York State Supreme Court Mandatory Settlement
