THE NEW YORK STATE BAR ASSOCIATION OFFERS PHYSICIAN'S
HIPAA PRIVACY MANUAL
A one-of-a-kind easy to understand manual
is now available to help health care providers and their legal counsel
navigate the often murky waters of the HIPAA Privacy Act. This new
hands-on tool has just been jointly released by the New York State Bar
Association’ Health Law Section and the Committee on Continuing
Legal Education.
Enacted by the U.S. Congress in 1996, The
Health Insurance Portability and Accountability Act (HIPAA) protects
health insurance coverage for workers and their families when they
change or lose their jobs, requires the establishment of national
standards for electronic health care transactions, and addresses the
security and privacy of health data.
Co-authored by Association members
Lisa McDougall of Buffalo , a partner
at Phillips Lytle LLP, and Christopher R. Viney of Buffalo,
deputy general counsel at Roswell Park Cancer Institute, the HIPAA
Privacy Manual provides day-to-day guidance to a physician’s
office in responding to routine inquiries about protected health
information. Containing 36 policies and
procedures and corresponding forms, the Manual provides the framework to
enable heath care providers’ counsel to address issues including
uses and disclosures of medical information without patient
authorization, operational guidelines, and patient
rights.
“The rules governing HIPAA
compliance can be difficult to navigate for legal experts and even more
so for physicians who have little or no legal training,” said
Peter J. Millock, the Chair of the Association’s Health Law
Section and a partner in the firm of Nixon Peabody.
“The HIPAA Manual is a necessity for anyone who finds
himself at the cross section of law and medicine and is unsure about how
to store, disseminate, or protect individual medical information and
records.”

New York State Bar Association members and $95 for Non-Members (prices
