This program will help the matrimonial lawyer understand the structures and major characteristics of the forms of business entities, and how these characteristics, depending on the type of business entity at issue, will determine the course and nature of a divorce proceeding and ultimately, what is available for equitable distribution.

After the always useful review of the latest cases, legislation and trends in matrimonial law, a team of experienced speakers consisting of a business lawyer, a CPA and a matrimonial lawyer focuses on each type of common business entity in turn to highlight its structure, how it differs from other entities (from both business and accounting perspectives) and finally, why these differences matter when a business is at issue in a divorce action.

This program offers advice and insight from expert professionals on very practical issues that impact any divorce case in which a business is involved:

• Why one business structure is preferred over others at the formation stage
• Why structural changes are made to a business after its formation
• Why different professionals prefer different forms of businesses
• What the tax returns of different businesses can tell you and what to look for on them, especially as to income and valuation
• What really is available to spend for support purposes
• Phantom cash vs. real cash
• “Economic reality”: soft and hard assets, i.e., enhanced earning capacity vs. book value
• How different entities affect discovery and settlement possibilities in the divorce action
• How this business asset can be divided for equitable distribution
