Elder Law attorneys are becoming increasingly involved with issues affecting younger individuals with disabilities.  Indeed, many of the issues that Elder Law clients encounter on a regular basis – diminished capacity, government entitlements, access to long term health care and housing needs – also challenge younger persons with disabilities.

In many cases, effective representation of the younger client with a disability involves the drafting and administration of Supplemental (Special) Needs Trusts. These trusts are used in many different contexts, from protecting litigation proceeds to managing inherited funds for those without capacity, to providing a supplemental source of money to help enhance the lives of individuals with disabilities residing in the community.  This recording provides a comprehensive cross-section of issues faced by attorneys practicing in this area, including a brief history of Supplemental Needs Trusts in New York State, drafting tips for both third party and settled trusts, suggestions on working with the personal injury bar, and an overview of some of the important public entitlement programs that serve clients with disabilities and their families.
