The Torts, Insurance, and Compensation Law Section of
the New York State Bar Association is pleased to welcome Section members
and visitors. Among the resources available for Section members on this
site are Section publications, access to the TICL Section e-community
discussion forums, and substantive case reviews via Law Watch search
results on topics of interest to the Section. Section members receive
the Torts, Insurance and Compensation Law Section Journal and
the Construction & Surety Law Newsletter free as a benefit
of membership.
A View from the Chair - February 2012

In 2012, I look
forward to building upon the successes of my dynamic predecessor, Thomas
Maroney. With the able help of Vice-Chair Robert McCarthy,
Secretary Lisa Berrittella and Treasurer Brendan Baynes, I know we will
accomplish much this year.
Diversity. With the launch of the
Section’s acclaimed “Strength by Association” series,
Tom Maroney made diversity a central focus of his term as Section Chair
in 2011. The series will continue this
year, with regional membership and recruitment events and colloquia
featuring lawyers and judges from diverse
backgrounds. We will also explore the
theme at the Section’s Summer Meeting in Montréal (August
16-19), with contributions from our Québec counterparts and from
various minority and women’s bar associations. To get involved

Legislative
Initiatives. The Section advises the NYSBA on New York legislation and
rulemaking that impact our members’ areas of
practice. With a diverse membership
that includes defense counsel, plaintiffs’ counsel, insurance
company in-house counsel, outside coverage counsel for insurers and
policyholders and workers’ compensation practitioners, the Section
is uniquely positioned to provide a balanced
view. In 2011, the Section advised the
Association to oppose a bill that would have imposed a cap on
non-economic damages awards in medical malpractice
suits. The Section also participated in
ongoing dialogue with the Workers’ Compensation Board to dissuade
the Board from adopting rules that would infringe due process rights of
claimants and employers. Already in
early February 2012, the Section is examining and debating an Assembly
Bill on service of process upon corporations and limited liability
companies, and another bill that would mandate early hearings on
workers’ compensation claims. For more information or to get

Professional
Growth. This year, we re-affirm our commitment to providing valuable,
relevant and up-to-date educational programs and professional
publications. In this year’s
lineup are seminars on depositions, basic and advanced tort and
insurance topics, and of course the annual Law School for Insurance
Claims Professionals. The Summer
Meeting in Montreal will treat issues pertaining to domestic and
international litigation and will feature break-out sessions for
newly-admitted attorneys. The
Section Journal will continue to publish the
best scholarship in our practice areas, and the
Section’s e-Newsletters will continue to
feature case notes that are both pithy and
timely. For more information on

Networking. Professional growth involves more than study and experience in
the field. Networking counts,
too. The Section fosters interaction
through local, regional and state-wide gatherings throughout the year
and lively debates on the various substantive committee list
serves. Watch for event announcements

Leadership
Opportunities. The Section is
looking for its next generation of leaders. Those leaders get their start at the
Section’s Journal or Newsletter, as District Representatives or as Vice-Chairs of the
