The speakers at this important half-day program will discuss the new Article 83 of the Mental Hygiene Law, which became effective in New York on April 21, 2014.  They will also discuss advising Article 81 guardians and SNT trustees after they have been appointed by the court and recent case law developments.

Article 83 of the Mental Hygiene Law is the New York version of the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act.  New York is the thirty-seventh state to adopt this statute.  Its purpose is to prevent or minimize interstate jurisdictional disputes in adult guardianship cases.  It should make the litigation of interstate guardianship issues simpler and less expensive.

The first half of the program will be devoted to Article 83.  Issues that will be discussed include the basic structure of the statute, its applicability to Article 81 of the Mental Hygiene Law and Article 17A of the Surrogates Court Procedure Act, and litigation problems that may arise under the statute.

The program’s second half will focus on advising Article 81 guardians and SNT trustees after they have been appointed by the court and recent case law developments.

The program faculty members are experienced elder law and guardianship attorneys who will offer practical and useful guidance in this rapidly changing area.
