Former Court of Appeals Judge Robert Smith and former First Department Justice James McGuire will discuss motions in the Court of Appeals and Appellate Division for stays and injunctive relief pending appeal. In addition, they will also discuss CPLR 5704, the little-used provision that both grants broad review powers to the Appellate Division or a Justice thereof of orders granted without notice (such as TROs) and authorizes the Appellate Division to grant any order or provisional remedy (such as a TRO) applied for without notice that the trial court refused to grant
