In response to many requests from recent program attendees, the Family Law Section is pleased to present a full-day “Trial of a Custody Case” program which will be almost all demonstration by experienced matrimonial lawyers performing direct and cross examinations of a mother, father, and custody expert in a simulated child custody case. New York judges on the faculty will rule on the attorneys’ questioning and on evidentiary issues, when necessary, in the course of this simulated trial.

The faculty will convey recommended techniques in preparing for and trying a custody case. You will hear from the custody expert on how the report is prepared. The judge on the panel will review his/her role and the judge’s conduct of the Lincoln hearing in which the child (with the attorney for the child present) may be questioned by the judge in camera.

Substantial time has been built into the program for audience questions and panel discussion by the faculty. The program also includes the useful review of the latest cases and trends in matrimonial law.

The fact pattern that forms the basis of the program, along with the custody expert’s report, will be distributed to registrants so they may follow the proceedings.

This "custody trial" program continues the innovative CLE offerings of the Family Law Section and is full of practical guidance. This course will provide you with a fresh look at proven approaches, techniques and styles of successful matrimonial lawyers in custody cases.

All program materials are distributed exclusively online in searchable PDF format, allowing attendees more flexibility in storing this information and allowing you to copy and paste relevant portions of the materials for specific use in your practice. A CLE NotePad © (paper) will be provided to all attendees at the live program site. The CLE NotePad © includes lined pages for taking notes on each topic, as well as any PowerPoint presentations submitted prior to printing.

Prior to a scheduled program date, all registrants will receive an email message containing a hyperlink that when clicked will provide you with access to the complete course materials in a searchable PDF format which can be downloaded to your computer using the “Save As” option under your “File” tab. Printing the complete materials is not required for attending the program. Online materials are updated periodically to reflect last minute submissions from program faculty, guaranteeing that you will always have the latest version of the materials.

Traditional printed course books may be ordered at the program site for a discounted price and will be shipped subsequent to the program date.

This course has been approved for all attorneys, including those who are newly admitted (less than twenty-four months). Newly admitted attorneys must attend the program in person to receive New York MCLE credit.
